<p>For the last two years the real estate short sale has been a popular topic of conversation with investors as well as home buyers and sellers. Yes, but is the idea of a short sale much like kissing a frog with the hope it will turn into a handsome prince?</p>
<p>&#13;A short sale is when a bank or mortgage lender agrees to accept less than a homeowner still owes on a home. Lenders do that when there is not enough equity in the home to attract a buyer and pay all costs of a sale.</p>
<p>&#13;Ah yes, but a lender does not have to agree to a short sale and even with those that might consider cooperating it can be very difficult to make such deals work. That also makes home buying very difficult.</p>
<p>&#13;Banks have what&#8217;s called a loss mitigation department that handles foreclosure short sales. As the economy moves into a recession those departments have been swamped with foreclosures and are often unable to respond to a short sale request before the home is lost to the foreclosure auction.</p>
<p>&#13;A real estate agent experienced with short sale deals might be able to help, but less than about 5% of defaulting homeowners are able effect a short sale before the foreclosure.</p>
<p>&#13;Oh, but there&#8217;s more to it than that&#8230;</p>
<p>&#13;The big mortgage lenders package up their loans then sell them to investors all over the world. Sometimes the first buyer was Freddie Mac or Fannie Mae. They bought, packaged and sold millions of mortgage loans.</p>
<p>&#13;When a loan goes into default and a short sale is requested the lender needs to some how contact and negotiate with each investor who now owns a piece of the loan or loan package.</p>
<p>&#13;They ask Mortgage Investor #1 if he is willing to accept $ X00,000?<br />&#13;They ask Mortgage Investor #2 if he is willing to accept $ X00,000?<br />&#13;They ask Mortgage Investor #3 if he is willing to accept $ X00,000?<br />&#13;They ask Mortgage Investor #4 if he is willing to accept $ X00,000?</p>
<p>&#13;Maybe they can get in touch with everyone who owns a piece of the package and maybe not. Ah, but there&#8217;s more&#8230;</p>
<p>&#13;Often there is more than one mortgage loan on the home and the negotiation process starts over again with those additional investors.</p>
<p>&#13;See the problem? With a short sale you not only have to negotiate with the investors, you have to negotiate with multiple lenders, sometimes as many as two or three. And they also must negotiate with their investors.</p>
<p>&#13;For homeowners facing foreclosure the question is should you even try for a short sale? Not an easy question to answer, but consider the follow:</p>
<p>&#13;A home owner&#8217;s credit score will be damaged by going through foreclosure or by giving the home to the lender by means of a deed-in-lieu of foreclosure.</p>
<p>&#13;- Foreclosure or Deed-in-Lieu of Foreclosure</p>
<p>&#13;Sellers will take a credit score hit of something like 200 to 300 points. If before the foreclosure your FICO score was 680, it would drop as low as 380.</p>
<p>&#13;- Short Sale</p>
<p>&#13;Some say the hit on your credit score will be less with a short sale than a foreclosure. Others claim the damage will be identical. The short sale will appear as a &#8220;pre-foreclosure in redemption status&#8221; in your credit history. That may result in a credit score loss of 200 to 300 points. If your FICO was 720 you will see it fall to 520 to 420.</p>
<p>&#13;Are you doomed? If you have a foreclosure on your credit history will you ever be able to buy another home?</p>
<p>&#13;Sure you will IF you establish a good payment record with your other debts. After your foreclosure you might wait 24 to 72 months before a lender will offer a mortgage loan with a sensible interest rate. The more improvement you can show on your credit report the lower the rate of interest.</p>
<p>&#13;Most who have sold a home with the help of a short sale will be considered for new mortgage financing after two years if they show a responsible credit history. So the main advantage of a short sale is that you can be considered for a new mortgage loan within two years over the three- to five-year period required for foreclosures.</p>
<p>&#13;What about deficiency judgments? Are they going to squeeze you for every penny? Well, you could be subject to a deficiency judgment for the difference between the loan amount and the amount received by the lender in a short sale. Not to worry, many states have laws that no longer allow that and in the states that don&#8217;t have such laws lenders seldom go to the expense of trying to collect from someone who apparently has no money.</p>
<p>&#13;Have you heard that you can be taxed on unpaid foreclosure debit? Forget it, because The Mortgage Forgiveness Debt Relief Act of 2007 generally allows you to exclude income from the discharge of debt on your principal residence.</p>
<p>&#13;Oh yes, since Washington has decided to bail out the banks they have little incentive to take less than what you owe them on any debit. Can you say, &#8220;Good bye short sales!&#8221;</p>

<p>Basically a foreclosure is a situation in which a home owner defaults on the mortgage payments for his house. Such property which are foreclosures for sale are called as distressed because typically the home owner is in financial distress and has defaulted on his payments. The owner may be in financial distress because of the following reasons:</p>
<p>1. Laid off/fired or quit job</p>
<p>2. Unable to continue job due to medical conditions</p>
<p>3. Mounting debt and excessive bills</p>
<p>4. Tiff with co-owner or divorce</p>
<p>5. Relocation to another state due to job transfer</p>
<p>Getting foreclosures for sale does not happen in a day.  A typical foreclosure process can extend over a few months. Each stage of foreclosure offers different types of opportunities to the potential buyer.</p>
<p>There are three stages of foreclosure such as 1) Pre-foreclosure 2) Foreclosure Auction 3) REO stage or Real Estate Owned by banks.</p>
<p>Pre- foreclosure is the first stage in the process of foreclosures for sale. In this stage the home owner has not paid up the mortgage of the loan for the first time and is now considered as a defaulter.  A pre-foreclosure is also called as NOD (Notice of Default) Or Lis Pendens as a formal warning is sent to the home owner about default on his payment. Investors can find property at the cheapest rate at this stage. Further damage to the credit rating of the home owner can be avoided and the property can be transferred to the buyer at a mutually agreed upon rate. The best leads to learn about properties at this stage are attorneys, friends and acquaintances as well as real estate agents.</p>
<p>Foreclosure stage is the second step in foreclosures for sale. The auction is the next stage after the pre-foreclosure stage. You can attend an auction and bid for the property. Usually the auction is held at the county clerk’s office.</p>
<p>During an auction, the lender tries his best to get the best possible price on the property under foreclosure. At an auction sale, buyers are required to buy in cash and without having the facility for prior inspection of the property in concern. However an auction sale does permit good bargains as much as 40 to 50 percent below market value.</p>
<p>The best way to identify foreclosures for sale at this stage is via the county clerk’s office. Find out about notices of default that have been filed to locate pending foreclosure sales.</p>
<p>The foreclosure process will vary from state to state depending on whether it is a title or lien state which determines a judicial or non judicial form of foreclosure. Judicial foreclosures pertain to mortgages and take long to finish. Non judicial foreclosures involve deeds of trust, where a third party, a trustee handles the property after period of default.</p>
<p>Third stage is Real Estate Owned (REO) stage where the property reverts to the bank. REO properties are also a good opportunity to purchase foreclosures for sale as the bank is in a hurry to get rid of its ‘non performing asset”. Thus at each stage of foreclosure, there are numerous opportunities for obtaining foreclosures for sale.</p>

			<content:encoded><![CDATA[<p>There are so many foreclosure homes for sale that it&#8217;s getting kind of scary. No matter what state you live in, or what town, it&#8217;s not uncommon these days to find entire neighborhoods empty. Why are there so many foreclosure properties for sale? What&#8217;s going on? Are we headed for another depression like in the twenties and thirties? Is America going to become another third world country like all the doomsayers are predicting? Is our new President destroying our country like the talking heads on Fox News are predicting? Time can only tell. The truth is, however, that the increasing number of foreclosure homes for sale is caused by a myriad of reasons. Some are caused by fraudulent loaning practices, some are due to the slumped economy and some are caused by simply poor planning on the parts of the families that once lived in those foreclosure homes for sale.</p>
<p>Fraud</p>
<p>Most of the foreclosure homes for sale are empty because the families that lived in them really had no business buying a home in the first place. How did they qualify for a loan? Several years ago, lenders relaxed their criteria and offered &#8216;sub-prime&#8217; mortgages. These were mortgages for families with low credit scores. They were offered an initial interest rate that was very reasonable and many families jumped on the chance to finally live the American dream of becoming a homeowner. The problem came when, as was stated in the fine print that nobody read, that initial interest rate was set to jump in a few months. The mortgage payment doubled and sometimes tripled seemingly out of nowhere. This meant many families could no longer afford their homes and they were forced to move thus the houses became foreclosure homes for sale.</p>
<p>Slumped Economy and Poor Planning</p>
<p>The second and third reason for so many foreclosure homes for sale was that the economy is in a slump. People are losing their jobs, their wages aren&#8217;t lasting as long as they used to and families are not planning for the future properly. The fact is that many families live well beyond their means. Many are still living paycheck to paycheck. Whether they make twenty five thousand a year or a hundred thousand, if they don&#8217;t plan properly, one job loss can result in a foreclosure home for sale. And that&#8217;s what&#8217;s happening with all of these foreclosure homes for sale. People lost their jobs and they could no longer afford their mortgage payments. The banks demanded the houses back and that&#8217;s why there are so many foreclosure homes for sale.</p>
<p>It&#8217;s not all doom and gloom out there. The economy will bounce back eventually. But until then, hopefully we&#8217;ll learn from our mistakes so that we can get all these families back in their homes so there aren&#8217;t as many foreclosure homes for sale.</p>

<p>There are many foreclosures happening all over the country. This is mainly due to the sub-prime mortgage debacle that happened recently. This is when lenders relaxed their criteria to allow more people to realize the American dream of homeownership. The problem was that their attractive initial interest rates jumped after a few months. Many of these new homeowners never read the fine print so this jump in mortgage price was out of nowhere. This resulted in many foreclosures that we’re still seeing the residual of today. But it’s not just regular homes that are being foreclosed on. Government housing is also seeing an increase in foreclosures. HUD, the department of Housing and Urban Development, provides homes to those who can’t usually afford them. But with the economy the way it is today, some of these families can’t afford their homes even at the discounted rates. The government is forced to foreclose in these cases. Some of these families get foreclosure help from the same government that foreclosed on them in the first place but most of the families are forced to move. </p>
<p>Forced To Move</p>
<p>These government foreclosures for sale were just normal HUD houses and apartment buildings. The families who lived inside paid their mortgages, at reduced rates, but eventually, whether due to job loss or some other hardship, they could not pay at all. Usually, these government foreclosures for sale are the result of months of not paying. Eventually, though, the families are so in debt that there’s no hope of ever catching up. This is when the government files a foreclosure and a notice is posted. The family then has a certain amount of time to vacate the premises; usually about thirty days. After thirty days, however, if the family still isn’t gone, the government will file a writ of possession. This is when the local police will come and physically remove the family while their possessions are either sold at auction or sold back to the family for a certain cost. This is a sad situation but it’s one that’s happening at an increased rate as is evidenced by all the government foreclosures for sale popping up all over the place.</p>
